Why McCown, Fisher & Cremeans
Every Ohio OVI case hinges on procedure: the stop, the field sobriety tests, the breath, blood, or urine test, and the chain of custody. The State will present its case as airtight. We examine it methodically — with the credentials and the case experience to identify where it is not.
Our OVI defense attorneys hold NHTSA Field Sobriety Instructor credentials — meaning we have the training to train the same officers Ohio State Highway Patrol uses to administer these tests. We are also ARIDE-trained for drug-impairment cases and active National College for DUI Defense members.
Those credentials shape how the prosecution evaluates the case — and how aggressively we are prepared to challenge the science behind the State’s evidence.

OVI Cases We Defend
A first OVI conviction stays on a driver’s record permanently in Ohio — with no expungement or sealing. We pursue dismissal, reduction, or amendment whenever the facts and the law support it.
First Offense Defense →Mandatory jail, longer suspensions, ignition interlock, "OVI plates." The stakes escalate — so does our defense.
Repeat OVI Defense →A 4th OVI in 10 years is a Felony of the Fourth Degree. A 5th in 20 years (or any OVI after a felony OVI) is a Felony of the Third Degree — up to 5 years base prison plus a mandatory 1–5 year repeat-OVI specification. Common Pleas defense.
Felony OVI Defense →A breath result of .17 or higher doubles the minimum jail time. We attack the calibration, the operator certification to weaken the State’s case.
High BAC Defense →Drug OVI cases — including legal prescriptions — require ARIDE-level knowledge. We have it. The arresting officer's training? Often the same.
Drug OVI Defense →CDL drivers face a .04 BAC threshold and a career-ending disqualification on a single offense. When your commercial license is on the line, the defense has to address both the criminal case and the federal disqualification rules at the same time.

How We Work
Every case follows the same disciplined process — because every detail matters when your record is on the line.
Call either office for a confidential, no-cost case review. We listen, ask the right questions, and explain your options in plain English.
We review the traffic stop, field sobriety tests, breath / blood / urine results, and arrest procedure for every defense opportunity.
We build a strategy targeting the weakest links in the prosecution’s case — improper stops, challenges to field sobriety testing, calibration errors, and chain-of-custody breaks.
We negotiate aggressively for reduced charges or dismissal — and go to trial when that's what your future requires.
Ohio OVI Penalties
Ohio mandatory minimums under ORC §4511.19 escalate sharply with each offense. Penalties below reflect the law as currently in effect.

Common Questions
In Ohio, OVI stands for Operating a Vehicle while Impaired — what other states call DUI or DWI. Ohio uses the term OVI for all impaired driving offenses, whether the impairment comes from alcohol, illegal drugs, or prescription medications.
Immediately. You have only 30 days to request an Administrative License Suspension (ALS) hearing to challenge the automatic suspension of your license. Miss that window and the suspension stands, regardless of the outcome of the criminal case. Call (740) 532-8744 for the Ironton office, or (740) 867-3166 for the Chesapeake office, as soon as possible.
A refusal triggers an automatic 1-year Administrative License Suspension under Ohio’s implied-consent law, and the refusal itself can be used against you in court. There are situations where refusal is the right call and situations where it is not — but that decision is made before the stop, not after.
Important: A refusal by a driver with a prior OVI conviction within the last twenty years triggers Ohio’s criminal refusal statute under R.C. §4511.19(A)(2) — a separate criminal charge with enhanced mandatory minimums stacked on top of the underlying OVI.
If you have already refused, call us to challenge the suspension at the ALS hearing.
Yes. Common defenses include: lack of reasonable suspicion for the traffic stop; lack of probable cause for arrest; failure to provide proper Miranda warnings; defective field sobriety test administration under NHTSA protocols; failure to observe before a breath test; breath-machine calibration and maintenance errors; uncertified operator administering the test; chain-of-custody problems with blood or urine samples; suppression of statements made before counsel was provided; speedy-trial violations; and challenges to the qualifications of the State’s expert witnesses. Both Attorneys hold NHTSA Field Sobriety Instructor credentials — meaning we have the training to train the same officers Ohio uses to administer these tests. This changes how we approach the evidence.
Yes. A first OVI conviction in Ohio stays on the driver’s record permanently — there is no sealing and no expungement for an OVI conviction in Ohio. It will affect insurance rates, employment opportunities, and any professional licensure that requires disclosure. An experienced OVI attorney can often achieve outcomes — reduced charges, amended pleas, or dismissals — that are not available without representation.
